Can You Expunge a Criminal Record in Arizona?

Quick answer: For most offenses, Arizona does not “expunge” records in the traditional sense, but since 2023 you can seal them from public view under A.R.S. § 13-911, set aside the conviction under A.R.S. § 13-905, and truly expunge a qualifying marijuana offense under A.R.S. § 36-2862. You can also restore your gun and civil rights. The right tool depends on the charge, the outcome, and how much time has passed.

Every Arizona Path of Relief

Arizona gives you several distinct tools. They are not interchangeable, and using the wrong one wastes time and filing fees. Here is what each does and who qualifies.

Ways to Clear or Improve an Arizona Criminal Record
MethodStatuteWhat It DoesWho Qualifies
Record SealingA.R.S. § 13-911Seals your arrest, charge, and conviction from public view, so most background checks show nothing. Most non-dangerous offenses, after a 2–10 year waiting period from completion of your sentence.
Set-AsideA.R.S. § 13-905Vacates the judgment of guilt and adds a “set aside” notation, releasing most penalties of the conviction.Available after you complete probation or your sentence, for most offenses.
Marijuana ExpungementA.R.S. § 36-2862Truly erases a qualifying marijuana arrest, charge, or conviction, as if it never happened.Anyone with a qualifying pre-2021 marijuana offense (Prop 207), by petition since July 2021.
Restore Gun RightsA.R.S. § 13-925Restores your right to possess a firearm after a felony conviction.By application, generally 2–10 years after discharge depending on the felony.
Restore Civil RightsA.R.S. § 13-907Restores the right to vote, serve on a jury, and hold public office.Automatic for a first felony on completion; by application otherwise.

The right option depends on your specific charge, outcome, and waiting period. We can review your record and tell you which applies.

Arizona Record Clearing FAQs

How do you get a record expunged in Arizona?

Arizona uses record sealing (A.R.S. 13-911) rather than traditional expungement for most offenses, plus true marijuana expungement (36-2862). You file a petition in the court that handled your case, and once granted, the record is sealed from public view or erased.

How do I seal my criminal record in Arizona?

Under A.R.S. 13-911, you petition the sentencing court after your waiting period (2–10 years, depending on the offense class). If granted, your arrest, charge, and conviction are sealed from public and most employer background checks.

What does a set-aside conviction mean in Arizona?

A set-aside under A.R.S. 13-905 vacates the judgment of guilt and adds a notation that the case was set aside. The conviction still exists, but you are released from most of its penalties, which helps with employment and licensing.

What is the difference between sealing and setting aside a conviction in Arizona?

A set-aside vacates the judgment but the record stays public; sealing (13-911) hides the arrest and conviction from public view. Many people do both: set aside the conviction, then seal the record for the strongest protection.

Can you expunge a marijuana charge in Arizona?

Yes. Under Proposition 207 and A.R.S. 36-2862, you can petition to expunge a qualifying marijuana arrest, charge, or conviction, and it is truly erased, not just sealed. Petitions have been available since July 2021.

How do you restore your gun rights in Arizona?

You apply to the court under A.R.S. 13-925 to restore your right to possess a firearm after a felony. Eligibility and waiting periods depend on the felony class and whether it was a dangerous or serious offense.

How long does a criminal record stay on your record in Arizona?

Without action, a conviction stays on your record for life and appears on background checks. Sealing, set-aside, or expungement is the only way to limit or remove it, and Arizona now allows all three for many offenses.

Does a set-aside or sealing show up on a background check in Arizona?

A sealed record (13-911) should not appear on most private background checks. A set-aside conviction still appears but shows the “set aside” notation, signaling the court relieved you of the conviction’s penalties.
