Avondale City Court: What to Know
Misdemeanor DUIs that happen inside Avondale city limits are filed in Avondale City Court (623-333-5800), 11325 W. Civic Center Dr. The city’s website says prosecution is handled by an outside firm, Bustamante & Kuffner, based in Phoenix. Felony DUIs, such as aggravated DUI under ARS 28-1383, are filed in Maricopa County Superior Court.
One more deadline to know: the ADOT process. See how to stop a license suspension after a DUI in Arizona, what to expect at an ADOT hearing, and the statute itself, extreme and super-extreme DUI under ARS 28-1382.

From Arrest to Courtroom: The Avondale DUI Timeline
People are often surprised by how quickly an Avondale DUI case moves. Here is the usual order of events.
Day one: the stop, the tests and the arrest
Officers build a DUI case from the reason for the stop, their observations of you, the field sobriety tests and a chemical test. Each piece can be challenged separately, which is why details such as lighting, footwear, medical conditions and how the tests were explained matter.
The first 30 days: your license
If a suspension order was served, the request for an ADOT hearing has to be received within 30 days. That deadline arrives well before your court case is resolved. Read our guide to the ADOT hearing.
The first court date
The arraignment in Avondale City Court is a short hearing. You enter a plea, usually not guilty, and the court sets the next dates. If you are held in jail, you will first see a judge at an initial appearance, generally within 24 hours.
Pretrial and trial
Then come disclosure, pretrial conferences, motions to suppress evidence and plea negotiations. If the case does not resolve, it goes to trial.
What Are the Penalties for a DUI in Avondale?
The penalties for a DUI that happens in Avondale are the same as anywhere in Arizona, because they come from state law. They depend on the level of the charge, your BAC and your prior record. These are the statutory minimums:
| Charge | Jail or prison minimum | Fine and assessments | License and other |
|---|---|---|---|
| Standard DUI, first offense ARS 28-1381 |
10 consecutive days; the judge may suspend all but 1 day if you complete court-ordered screening, education or treatment | $250 minimum fine + $500 + $500 assessments | Ignition interlock when alcohol was involved; traffic survival school |
| Extreme DUI, BAC 0.15 to under 0.20 ARS 28-1382 |
30 consecutive days; the judge may suspend all but 9 if you run an interlock for 12 months | $250 fine + $250 + $1,000 + $1,000 assessments | Ignition interlock; traffic survival school |
| Super-extreme DUI, BAC 0.20 or more ARS 28-1382 |
45 consecutive days; the judge may suspend all but 14 with a 12-month interlock | $500 fine + $250 + $1,000 + $1,000 assessments | Ignition interlock; traffic survival school |
| Second standard DUI within 84 months ARS 28-1381 |
90 days, 30 of them consecutive; the judge may suspend all but 30 if you complete the required program | $500 minimum fine + $1,250 + $1,250 assessments | One-year revocation, 30 hours of community restitution, interlock |
| Aggravated DUI (felony) ARS 28-1383 |
Class 4 felony (class 6 with a child under 15). In several situations, at least 4 months in prison before probation can begin; 8 months with three or more prior violations | $750 minimum fine + $250 + $1,500 + $1,500 assessments | Driving privilege revoked, no new license for a year; interlock may run 24 months or more |
Minimums from the statutes, before the surcharges that courts add. A judge can order more than the minimum, and a prior DUI changes the numbers.
Two points in that table are easy to miss. First, jail time is often mostly suspendable when you complete the court-ordered screening and, for extreme DUI, run an ignition interlock, but a first-offense DUI still carries a real jail minimum. Second, the fines are small next to the assessments added to them. For a closer look, see our guides to extreme DUI jail time, super-extreme DUI jail time and a second DUI.
Can You Keep Driving After an Avondale DUI Arrest?
Often, yes, at least for a while, but only if you act inside the deadlines. The 30-day clock starts when the suspension order is served.
If you took the test
If you failed a breath or blood test and have no qualifying DUI in the past 84 months, the first suspension under ARS 28-1385 can run at least 30 days, followed by at least 60 days in which you can drive with restrictions, provided you complete the required screening. A hearing request has to reach ADOT within 30 days of the notice.
If you refused
A refusal under ARS 28-1321 carries its own suspension: 12 months for a first refusal and 2 years for a second within 84 months. The order takes effect 30 days after it is served, and ADOT must set the hearing within 60 days of a request. Read more in our guide on refusing a blood draw.
The restricted license option
In some situations ADOT can issue a special ignition interlock restricted license, which lets you drive with a device installed. Accepting it waives the administrative hearing, so it is a trade-off worth discussing with a lawyer first. See also how long an interlock lasts.
How an Avondale DUI Case Is Proved, and Where It Can Break
A DUI conviction rests on a chain of steps, and each link can be tested.
The stop
The officer needs reasonable suspicion to pull you over. If the stop was not justified, the evidence that follows can be suppressed.
Field sobriety tests
The standardized tests are the eye test, the walk-and-turn and the one-leg stand. They are scored against a checklist, and they are affected by age, weight, injuries, footwear, nerves and the surface you stand on.
Breath and blood tests
A BAC of 0.08 or more counts only if it was reached within two hours of driving. Breath instruments need maintenance and a certified operator. Blood results depend on how the sample was drawn, stored and handled. See our guides on challenging a blood test and DUI checkpoints.
Drug DUI
A drug DUI charge can rest on any listed drug or its metabolite in your body. A valid prescription is a defense to that charge, and a metabolite test says little about actual impairment.
When an Avondale DUI Becomes a Felony
Aggravated DUI under ARS 28-1383 is a felony. A DUI is charged as aggravated when any of these is true:
- you were driving while your license was suspended, canceled, revoked, refused or restricted;
- it is your third DUI within 84 months;
- a child under 15 was in the vehicle (a class 6 felony; the others are class 4);
- you were required to have an ignition interlock device and did not;
- you were driving the wrong way on a highway.
Felony DUIs are filed in Maricopa County Superior Court, not in Avondale City Court. In several of these cases the statute requires at least four months in prison before probation can begin, and eight months with three or more prior violations. Read more in our guides on DUI on a suspended license, DUI with a child in the car and a fourth DUI.
What an Avondale DUI Really Costs
The fine is the smallest part of the bill. Even for a first-offense DUI the statutory assessments add $1,000 to the $250 minimum fine, and extreme and aggravated DUIs carry assessments in the thousands.
- Court costs: the fine plus the assessments listed above, and the surcharges courts add.
- Required programs: screening, education or treatment, and traffic survival school.
- Ignition interlock: a device you pay to install and maintain on any vehicle you drive, often for 12 months or more.
- Lost time: court dates, jail time, community restitution and the license suspension.
- Attorney fees: DUI lawyers in Phoenix area often charge between $4,500 and $10,000 or more, depending on the facts and the BAC.
That last item is the one you control. A strong defense can reduce or remove several of the others, so the fee should be weighed against what is at stake, not against the lowest quote.
Seven Mistakes That Hurt an Avondale DUI Case
- Talking about where you were drinking and how much, beyond providing your identification.
- Letting the 30-day ADOT hearing deadline pass.
- Missing your first court date in Avondale City Court, which can lead to a warrant.
- Driving while your license is suspended, which can turn a misdemeanor into an aggravated felony DUI.
- Skipping the court-ordered alcohol screening, which can cost you the suspended part of your jail sentence.
- Posting about the arrest or the night online.
- Waiting to hire a lawyer until after the first hearing, when video may already have been overwritten.

Why Tamou Law Group for DUI Charges
A DUI case in Arizona is decided by the stop, the test and the deadlines, not by the arrest report. We handle it as a science case and a procedure case at the same time, from the first MVD deadline through trial.
DUI-specific credentials
Michael Tamou is a member of the National College for DUI Defense and the DUI Defense Lawyers Association, the two national organizations devoted to breath, blood and field-sobriety science. That training is what lets us cross-examine a gas chromatography result instead of accepting it.
Both sides of the courtroom
Our team includes former prosecutors and law enforcement officers who have built DUI cases for the State. They know what a DUI unit has to document, what it skips when it is busy, and where a case breaks when the paperwork does not match the body camera.
Volume that matters
Michael handled roughly 500 cases a year at the public defender’s office, against the 50 to 60 a typical attorney sees. A DUI defense built on that volume knows which plea offers are policy and which are negotiable in Maricopa County courts.

Frequently Asked Questions
Can my license suspension be stopped after an Avondale DUI?
Often it can be delayed. A DUI lawyer can request a hearing and a stay with the Arizona Department of Transportation while the criminal case is pending, which typically has to happen within 30 days of the arrest or citation.
When should you hire an Avondale DUI lawyer?
As soon as you can after the arrest. The license suspension process starts quickly and the request for a hearing generally has to be made within 30 days, so waiting costs you options. An experienced DUI attorney can challenge the evidence and work to reduce or dismiss the charges.
Do you need a DUI lawyer with an office in Avondale?
No, but you do want one who appears in Avondale City Court and deals with the prosecutor regularly. Ask any lawyer you interview how many cases they have handled in that court, and who would actually attend your hearings.
How much does an Avondale DUI attorney cost?
DUI lawyers in Phoenix area often charge between $4,500 and $10,000 or more, depending on the facts of the case and the BAC. Ask for the fee and what it covers in writing, including whether trial is included.
When does an Avondale DUI become a felony?
Aggravated DUI under ARS 28-1383 is a felony. It applies to a DUI while your license is suspended, canceled, revoked, refused or restricted, a third DUI within 84 months, a DUI with a child under 15 in the vehicle, a DUI while a required ignition interlock is installed, and wrong-way driving on a highway.
How does Tamou Law Group defend Avondale DUI cases?
We look at why the officer stopped you, whether there was probable cause to arrest, how field sobriety tests were given and scored, whether the breathalyzer was maintained and the operator certified, how blood was drawn and stored, and whether your BAC may have been rising between driving and testing. Medical conditions, Miranda issues and lack of actual physical control can matter too.
What happens at the first court date for an Avondale DUI?
The first appearance in Avondale City Court is usually an arraignment, where the charge is read and you enter a plea. Pleading not guilty preserves your rights and gives your lawyer time to review the evidence, so you should not plead guilty before you have spoken to one.
How much jail time is there for a first DUI in Avondale?
A first standard DUI carries a statutory minimum of 10 consecutive days in jail under ARS 28-1381, but the judge may suspend all but one day if you complete court-ordered alcohol screening, education or treatment. Extreme DUI carries 30 days, or 45 days at a BAC of 0.20 or more, with part of that suspendable if you run an ignition interlock for 12 months.
Can I be charged with DUI for marijuana or prescription drugs?
Yes. The drug provision of ARS 28-1381 applies when a listed drug or its metabolite is in your body while you drive, and metabolites can remain long after any impairment ends. A valid prescription is a defense to that charge, and testing and timing are common points of attack.
